  Do you think the parent is negligent & should legal action be taken?

Now that I think about it, who would be taking the legal action? If the parent is negligent then who is suing? For now, my answer is no because the parents didn't tip the thing over, a bump did. It was an accident. Maybe they were not meant for more than one passenger?

I think they've been punished enough.

I'm going to make a guess. The Survey Creator doesn't have kids?

I'm not saying kids getting killed on ATVs doesn't piss me off. It does. I lived in NC for a few years, so I was quite familiar with the little collection jars in gas stations with some unfortunate child's picture.... asking for donations to pay for funerals and for families whose children were killed in ATV accidents. I never contributed..... because I've always felt the kids shouldn't be on the vehicles anyway.... but I don't think the parents should receive further punishment.

No. It's tragic but creating laws to try to stop this will not help. Nor will it help for society to attack parents who have lost a child this way. That's just adding cruelty on top of tragedy.

Most kids do a few crazy/stupid things as they grow up. Most of us survive, most of us learn from our mistakes. Tragedies happen. Trying to protect ourselves and our children from every little things only leaves us with too many laws and not enough freedom to be ourselves.

Survey Creator does know the child very well. I was just wondering if anyone else thought the parent was negligent based on this article. I have been grieving since the accident. Negligence was brought up by some of the respondants to the article & I defended the family. I didn't mention I knew the child because I didn't want to sway the vote.

I think I'd have to know an awful lot more about the incident than what's given here to think I had an opinion of even the least validity.

no and no, they made the decision as parents to allow her to ride the ATV. i don't think i would allow my child to ride one of these until they were 18 or older and made their own decisions but it was their decision. i have seen too many injuries in the hospital from these.
anyway, it was an unfortunate accident and i am sure they are rethinking their decisions. they really don't need to be punished any more than they will punish themselves over this.

Absolutely not.... this is a ridiculous question to me.. Why would they be in trouble for letting their kid play on an ATV?

Yes, we all know Memorial Day is a happy occasion, where you normally have cookouts with the whole family and do fun family things. Laugh, run, play, ride ATVs, ride SKI-DOOs, play with your cousins....Now it will be ruined forever having to remember someone who died. Memorial Day will never be the same for them......

I know I am obnoxious, but really... * rolls eyes *

For the record, I do feel for the family and it's sad, but that guy who made the comment that it's a sad thing to happen "this Memorial Day weekend".... GEEZ!

The comments I read seemed to pointing towards negligence. Yes, bringing up charges. That is how I percieved it.

It doesn't even say what the legal age to ride those things are. Or did I miss that? If they were obeying the law, then no charges should be filed.

By losing their child, I think the parents have been punished far worse than any court of law could do.

Maybe. Tough one. These kind of ATV accidents happen too much.I thought they outlawed them. There needs to be responsibility taken and unfortunately no one will till someone dies. Now that hundreds have died they are still driving those damn things around. Sue the city for allowing them to own and opperate them.
